Testimony of the week

Company: Buchholz & Garber LLC

Test result: Negative

The standard protocol where I work is no drug testing. However, it is in our employee handbook that if there is suspected drug use (based on behavior, etc) there will be a mandatory drug test. If we fail it, we have to pay for the test and go to rehabilitation. The rehab is covered by our insurance. In the state I live cannabis is legal and has been legal for medicinal purposes for a long time. Our handbook also says that even if we use cannabis with a prescription, for medical purposes, we are subject to the "zero tolerance " policy. There is no difference to them, drug use is drug use. I believe that their policy would not withstand an employee suing them if they were fired for medicinal use. I suppose that it would depend on whether it is affecting their job performance or not.
